The use of this website of the company VI Scientific Ltd (‘VI Scientific’) is governed by the following of Terms of Use. The terms and conditions of use are intended for any person visiting VI Scientific pages or use of its services. All services existing on this website or likely to be created or uploaded in the future are subject to these terms and conditions of use whether visiting, viewing and or using any services contained in the website visceintific.com presupposes the acceptance and submission to these terms and conditions of use.
Trademarks and Intellectual Property Rights
The copyrights and the Intellectual Property rights of the websites and the screens displaying any page except where otherwise expressly provided, that is, rights regarding the text, graphics, pictures and information contained in this website, are owned by VI Scientific. Permanent copy and/or saving all or part of this website or the information contained in it or the reproduction or embodiment on paper or electronic means or in any other form for any purpose, is strictly prohibited unless authorized by the respective owner.
Conditions & Terms of Use
1. Services: Through this site, VI Scientific provides you with access to a variety of resources, including developer tools, download areas, communication forums and product information (collectively the "Services"). The Services, including any updates, enhancements, new features, and/or the addition of any new products, are subject to these Terms and Conditions of Use.
2. Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.
3. Software Products: Any software that is made available to download from the Services ("Software") is the copyrighted work of VI Scientific and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). An end user will be unable to install any Software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms.
The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE.
THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, VI Scientific HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
VI Scientific may make available as part of the Services or in its Software products tools and utilities for use and/ or download. VI Scientific does not make any assurances with regard to the accuracy of the results of output that derived from such use of any such tools or utilities.
4. Content/ Information: VI Scientific and/or its respective suppliers make no representations about the suitability of the information contained in this site and related graphics, images, videos, audio, texts published as part of the Services for any purpose. All such information and material referred are provided “as is” without warranty of any kind. VI Scientific and/ or its respective suppliers hereby disclaim all warranties and conditions with regard to such information including all warranting and conditions of merchantability whether express, implied or statutory, fitness for a particular purpose, title and non- infringement.
5. No Warranty: VI Scientific does not warrant the accuracy, adequacy or completeness of the information and the material contained in the website and any information displayed is subject to alterations without previous notice. The tools, documents and related graphics, video, audio published on the Services or contained in the Software could include technical inaccuracies or typographical error. Changes are periodically added to the information herein. VI Scientific may make improvements and/or changes in the Services and/ or Software Products described herein.
6. Limitation Liability: VI Scientific expressly disclaims any liability for direct or indirect loss or damage which might result from the use or incompetence in use of the website or from errors, omissions, mistakes, typing mistakes or otherwise or system failure due to force majeure or for whatever other reason.
7. Orders and Payment: If you elect to purchase a Software product as provided in this siteyou will be given clear instructions to follow in the Order Form and you shall be required to provide us with your complete personal details, together with those of the intended recipient and all necessary payment details. By clicking on the 'Proceed to Checkout' button on the Order Form, you are consenting to be bound by the terms and conditions contained in these Terms of Use and Privacy Policy and such other terms appearing anywhere on the vscientific.com site. Submitting your Order Form is subject to our acceptance of this offer when we issue a written confirmation of acceptance by e-mail to the e-mail address with which you have addressed us. We will confirm your order details. You have to be 18 years old or older in order to have an Order Form accepted (Please refer to section 11, Delivery).
8. Internet Payment: Any payment made under this site is a secure Internet payment service offered by J CC PAYMENT SYSTEMS LTD (jcc.com.cy) (hereinafter referred to as "JCC") to you, the customer, to pay for the goods or services you have ordered from vcientific.com. By submitting your credit card details, you understand and agree that JCC will charge the credit card you entered for the amount of the transaction and agree to our Privacy Policy.
9. Authorization to Charge Your Card: Upon receiving authorization from the issuer of your credit card, JCC will process the transaction on your behalf. When you use your Card, you will be transacting directly with VI Scientific and not JCC. JCC will simply process the transaction through its secure Internet payment system. The name of the merchant, and not JCC, will appear on your credit card statement. In case that your card is rejected or not authorized by the system or JCC the Order and the transaction will be automatically cancelled and a notification will be sent to you by email. At this stage payments can be effected by VISA and/or MasterCard.
10. Currency Conversion: All transactions through viscintific.com are in Euro and if your currency is not Euro you should note that conversion of currency will be effected on submission of payment as provided by JCC ( jcc. com.cy).
11. Delivery: Delivery cost is included in the price quoted on the Order Form.
The transaction is completed upon delivery to you of a serial number by email to allow you to download the Software on your device. On acceptance by us of your Order we will advise you by e-mail confirmation of the intended delivery date of the serial number if such delivery cannot be made within 48 hours of your order.
12. Process of Order: VI Scientific will process Orders received on Sundays or Public Holidays the next working day. We do not deliver on Sundays. Incorrect personal or IMEI number (International Mobile Equipment Identity) or card details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, daytime contact telephone number so that we can notify you in the event that any delivery problems are encountered.
13. Receipt: Upon completion of payment of your Order a receipt will shown on your computer screen and the same will be sent to you by email confirmation on the email provided on your Order From.
14. Cancellation: Once an Order has been submitted and the transaction is completed by the delivery of a serial number by email to you, the Order cannot be cancelled. If you have any questions regarding such a good or service, please contact the viscientific.com Customer Service Team from 9am until 5pm Monday to Friday using the contact details set out in Contact Details or by email at info@viscinetifc.com.
15. Personal/ Non- Commercial Use: The user agrees that the material which is downloaded or otherwise is accessed with the use of the website is received entirely under his or her own responsibility and he or she will be entirely responsible for any resulting damage to the software or to the computer systems and/or for any resulting loss of data. VI Scientific does not guarantee that this site or the servers from which this site is placed at the disposals of users do not contain viruses or other harmful components.
16. Not unlawful use: As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any VI Scientific server, or the network(s) connected to any VI Scientific server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any VI Scientific server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
17. Third Parties: VI Scientific shall not be liable in respect of the site of third persons to which there is access through this website and does not approve nor accepts nor adopts the content of any such website. A link to another site or service is not an endorsement of that site or service. Any use you make of the information provided on this site, or any site or service linked to by this site is at your own risk.
18. Collection Data: VI Scientific collects information from users at different points on viscientific.com and does not provide such information to third parties unless as specified on Privacy Policy. Users acknowledge that when reading pages and all of Services under this site, non-personal information may automatically be collected in the form of cookies used to recognize users who often visit this site. By agreeing to be bound by these Terms of Use, VI Scientific has the right to collect and store personal data about you in accordance with the Privacy Policy. This data will be used to provide the service applied for and may be stored by the VI Scientific to keep you informed of products and services that may be of interest to you. The data will not be used other than in the normal course of VI Scientific business.
19. Legal / Jurisdiction: The use of this website is subject to the laws of the Republic of Cyprus and should any term in these Terms of Use be considered invalid from any supervisory court, the invalidity of this term will not impair the validity of the other terms which will remain at full force and activity.
20. The user agrees with VI Scientific and agrees to submit any disagreement resulting from the use of the site at the jurisdiction of the courts of the Republic of Cyprus.
21. The omission of VI Scientific to implement any right under these Terms of Use and Conditions shall not constitute exclusion of any right unless and if this becomes expressly accepted by VI Scientific in writing.
22. This site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.
23. VI Scientific may at any time amend any or all Terms of Use contained herein and users will be considered as having received notice and bound by the changes.
